Welcome to Oso Stretch & Wellness ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our services and facilities. By accessing or using any of our services, you agree to comply with these Terms. Please read them carefully before engaging with our services.

1. General Terms

These Terms apply to all clients, visitors, and users of Oso Stretch & Wellness. By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to our website or physical premises. Your continued use of our services constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use our services. Minors aged 16 or 17 may use our services with the written consent of a parent or legal guardian. All clients must complete a health and wellness intake form prior to receiving services.

3. Health and Safety

• Medical Clearance: Clients are responsible for consulting with a physician before starting any new fitness or wellness program, including our stretch therapy services. By participating, you confirm that you are in good health and capable of participating in our services.
• Assumption of Risk: Participation in our services, including but not limited to partner-assisted stretch therapy, involves physical activity and carries inherent risks. By using our services, you acknowledge and accept these risks, including but not limited to the risk of injury, muscle soreness, and other physical conditions.
• COVID-19 and Infectious Diseases: Clients agree to follow all local, state, and federal guidelines related to COVID-19 and other infectious diseases. This includes but is not limited to mask-wearing, hand sanitizing, and social distancing as required. Clients must inform us immediately if they test positive for COVID-19 or have been in close contact with someone who has tested positive.

4. Liability Waiver

By participating in our services, you agree to release, waive, discharge, and hold harmless Oso Stretch & Wellness, its owners, employees, and affiliates from any and all liability, claims, demands, or causes of action arising from your participation in our services. This waiver applies to all claims, including those resulting from negligence. This waiver is governed by the laws of the State of Texas and McLennan County.

5. Payment and Refund Policy

• Payment: Full payment for services is required at the time of booking unless otherwise agreed upon.
• Memberships: Clients signing up for memberships agree to an automatic monthly payment to be processed on the anniversary date of sign-up using the payment method provided by the client. Memberships may be canceled at any time with a 30-day written notice. Membership rates will vary based on the package selected by the client.
• Cancellations: Clients must cancel appointments at least 24 hours in advance to avoid being charged the full service fee.
• Refunds: All sales are final. Refunds will only be issued in cases where services cannot be rendered due to our fault or unforeseeable circumstances.

6. Privacy Policy

We respect your privacy and are committed to protecting your personal information. Our Privacy Policy, available on our website, outlines how we collect, use, and safeguard your information.

7. Code of Conduct

We are committed to providing a safe, respectful, and welcoming environment for all clients. Harassment, discrimination, or abusive behavior of any kind will not be tolerated. We reserve the right to refuse service to anyone who violates these Terms or engages in inappropriate behavior.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from or related to these Terms shall be resolved in the courts of McLennan County, Texas.
